About the Lab

Professor Yoomin Won's research lab specializes in international human rights law, with a focus on the domestic implementation of international human rights norms, state accountability during emergencies, and the role of international human rights instruments in constitutional adjudication. Her work examines how treaty bodies' recommendations are translated into domestic legal practice, particularly in East Asian jurisdictions such as South Korea and Japan, and investigates the interplay between international human rights law and domestic constitutional law. The lab employs mixed-methods research, combining qualitative case studies with quantitative analysis of judicial decisions and state reporting practices.

Yoomin Won
SJR Q1FWCI 9.7International Journal of Constitutional LawOA

Abstract Confronted with COVID-19, states have taken emergency measures derogating from human rights obligations. With the pandemic now declared over, it is time to review state practice and the derogation systems under international human rights treaties. This article examines all 373 notifications sent from states to the treaty organs of three treaties—the International Covenant on Civil and Political Rights (ICCPR), the European Convention on Human Rights (ECHR), and the American Convention o

Yoomin Won
SJR Q1FWCI 2.3International Journal of Constitutional Law

While both international human rights law and constitutional law protect fundamental rights of individuals, it remains a question to what extent and for what purpose constitutional justice uses IHR instruments. This article offers empirical research on the use of IHR instruments with a case study of South Korea. Quantitative and qualitative analyses were conducted for all sixty-five decisions from the Constitutional Court of Korea that mentioned IHR instruments from 1988 to 2015. Findings show t

Derogation of Human Rights Treaties in Public Emergency and South Korean Practice ‒ including Martial Law and COVID-19 ‒
Yoomin Won
Korea International Law Review

In times of public emergency, states take emergency measures to control the national crisis and restore public order. These emergency measures often restrict individuals' freedom and rights that are protected under international human rights treaties. The International Covenant on Civil and Political Rights, in its article 4, allows states to derogate from their obligations under the Covenant in time of public emergency. This is to adopt emergency measures to control crisis and, more importantly

The UN Human Rights Treaty System
Yoomin Won

Through a use of both qualitative and quantitative methodologies, Won provides a nuanced analysis and discussion of the factors and domestic processes influencing the implementation of United Nations Human Rights Committee (UNHRC) recommendations in South Korea and Japan, as well as across the globe.
