본 논문에서는 담합으로 인한 손해배상청구소송에서 요구되는 손해액 산정방법에 대하여 연구한다. 먼저 우리나라 손해배상청구소송의 현황을 파악하기 위하여 법원도서관의 판결문 DB를 검색하여 1심 판결일 기준 2014년 6월 31일까지 제기된 모든 소송의 내용을 검토하여 소개한다. 다음으로 기존의 국내외 연구에서 자주 언급되었던 손해액 산정방법을 간략히 정리하고 학술논문에서 분석한 외국의 사례들을 살펴본다. 이어 법원에서 감정인을 선임하여 손해액을 산정한 우리나라 소송 6건에 대해서 감정인의 손해액 산정방법을 중심으로 소송의 내용을 보다 자세히 살펴본다. 마지막으로 우리나라의 소송 현황과 국내외 손해액 산정방법에 대한 이해를 바탕으로 담합으로 인한 손해액 산정에 있어 보다 적극적인 활용과 논의가 필요하다고 판단되는 예측접근법, 도구변수 분석법, 시뮬레이션 방법의 활용 가능성과 장단점 등을 논의한다.

Magnolia sinica, distributed in Yunnan province of China, is a critically endangered (CR) species based on the IUCN Red List. 본 논문에서는 우리나라의 입찰담합 규제제도와 규제현황을 분석하고 이를 근거로 입찰담합 규제제도의 개선방향을 모색한다. 입찰담합은 공정거래법, 형법, 건설산업기본법, 국가계약법 등에서 규제되고 있으며 공정거래위원회와 입찰 발주기관에서도 입찰담합 예방을위한 제도들을 운영하고 있다. 공정거래위원회에서 공개하는 의결서 내용을 정리하여 구축한 데이터를 분석하여 입찰담합 규제현황을 파악하였는데 특히 제조업과 건설업 입찰담합의 규제현황을 자세히 살펴보고 자진신고자 감면제도가 입찰담합 규제에 미치는 영향을 분석하였다. 이러한 규제제도와 규제현황의 분석 결과를 바탕으로 본 논문에서는 다음의 정책방향을 제시하였다: (i) 입찰 발주기관이 입찰담합의 조사와 입증에 기여할 수 있는 제도적뒷받침이 필요하다; (ii) 건설업 입찰담합에서는 자진신고자 감면제도의 효과에 의심이 제기되는 등 다른 산업에서 나타나지 않는 특징이 있으므로 건설업의 특성을 고려한 규제방법이 필요하다; (iii) 제조업의 복수물품 입찰
