About the Lab
Professor Jin-gon Kim's research lab specializes in constitutional law, with a primary focus on labor rights, particularly the constitutional protection of workers' rights to organize, collectively bargain, and engage in industrial actions. The lab explores the theoretical and practical implications of constitutional rights such as the right to join or refrain from joining labor unions, examining the balance between individual freedoms and collective labor rights under the South Korean Constitution. Current research also investigates the constitutional validity of workplace union security arrangements, including 'union shop' provisions, within the broader framework of fundamental rights and state obligations.

5헌법 제33조는 근로자의 노동3권을 단결권·단체교섭권·단체행동권으로 규정하고 있다. 그 중에서 단결권은 근로자가 자주적이고 자율적으로 노동조합을 결성할 권리를 말하는데, 이러한 노동조합의 결성에 가담하지 않을 자유가 존재하느냐에 대하여 논란이 있다. 여기엔 세 가지 측면에서 접근하는 관점이 논의될 수 있다. 첫째, 헌법 제33조에서 규정하는 단결권이 적극적 단결권과 소극적 단결권을 모두 포함하는 것으로 볼 것인지에 그 핵심이 있다. 둘째, 만약 헌법 제33조가 적극적 단결권만 허용하고 소극적 단결권을 부인하는 논리에 선다면 구체적으로 다른 헌법규정 어디에서 소극적 단결권을 도출하느냐에 관심이 모아진다. 셋째, 소극적 단결권을 다른 헌법규정에서 도출할 수 있다면 조직강제를 규정하는 이른바 Union Shop조항의 위헌성을 판단하는 경우에 어떤 논리를 구성할 것인가에 있다. 위 세 가지 쟁점에 대하여 첫째, 헌법 제33조에서는 소극적 단결권과 적극적 단결권을 함께 보장하고 있는 것으로
