한국의 「디자인보호법」은 미감을 불러일으키는 디자인만을 보호대상으로 하면서 심미성의 충족을 요구하고 있다. 본고에서는 미와 미감이 무엇이고, 어떻게 해석되어야 하는가에 대한 논의를 전개하면서 현행법상의 디자인 성립요건으로서 심미성 해석을 완화할 것을 주장하였다. 본문의 전개는우리나라를 포함하는 일본, 중국, 그리고 미국과 유럽연합 5개국의 디자인보호법률상에서의 심미성 요건에 대한 입법 태도를 비교·분석하고, 심미성요건이 법적 관점에서 그리고 디자인 실무에서 어떻게 해석되고 있는지를고찰하였으며, 심미성에 관한 새로운 해석의 방향을 두 가지 안으로 제안하였다. 첫째, 디자인 성립요건으로서 심미성 요건을 우미 외의 추미 등을 포함하는 개념으로 확대·해석될 수 있도록 하거나 둘째, 장식성의 수준으로그 개념을 축소하여 해석될 수 있도록 하는 안이다. 본문에서는 심미성 관련한 이러한 새로운 해석의 타당성에 관한 논거를 제시하고 있다. 무엇보다도미적 가치라는 것은 그 자체가 주관적인 가치여서 객

프랑스의 명품 구두 브랜드 “Christian Louboutin”은 브랜드의 상징이 된레드솔의 빨간색 독점을 위한 전쟁을 치르고 있다. 본고에서는 Yves Saint Laurent과의 상표침해 분쟁을 다루었던 2012년의 미연방 제2순회항소법원판결을 중심으로 레드솔의 상표권 인정이 타당한지에 대해 조명하였다. 당시 루부탱 법정에서의 쟁점은 레드솔의 미적 기능성 존부와 단일색채가 패션업계에서 상표가 될 수 있는지에 대한 판단이었다. 피고 YSL은 항변의 논거로서 미적 기능성 원리, 색조혼동론, 그리고 색채고갈론을 제시하였다. 법정에서 부인되었던 이 이론들을 재검토한 결과로서 본고에서는, 1) 레드솔에 미적 기능성이 인정되며, 2) 레드솔의 빨간색을 소통함에 있어서 혼동가능성이 있고, 3) 레드솔의 단일색채 상표권을 인정하는 경우에 빨간색은 고갈될 것이라는 주장을 전개하고 있다. 레드솔의 상표 적격 여부 분석의 복잡성은 그 표장이 적용되는 상품이 패션제품이라는 점과 패션제품에서 색상은제
