Is There a Global Market for Convertible Bonds?

Prior to 1984, the stock price reaction to announcements of convertible issue in the domestic market was significantly negative, while the reaction to issues on the Eurobond market was smaller in absolute value and not consistently negative. After 1984, this difference in stock price reactions seems to have disappeared. 1962년 제정 「문화재보호법」과 일본의 문화재 보호 법령

1962년에 제정된 「문화재보호법」은 일본의 메이지(明治)시대 문화재 보호 법령인 「고사사보존법 (古社寺保存法)」(1897)을 비롯하여 식민지 조선의 문화재 보호 법령인 「조선보물고적명승천연기념물 보존령」(1933) 등 근대 일본의 문화재 보호 법령과 1950년에 제정된 일본의 「문화재보호법 (文化財保護法)」과의 유사성이 강하다. 특히 문화재 지정 기준의 핵심이라고 할 ‘역사의 증징(證徵)’, ‘미술의 모범’은 「고사사보존법」 이래 일본의 문화재 지정에서 금과옥조가 되어 식민지 조선의 문화재지정에도 중요한 기준으로 기능하였고 1962년에 제정된 「문화재보호법」에까지 영향을 미쳤다. 일본의 「문화재보호법」과도 문화재의 범주나 문화재의 개념, 지정기준 등에서 유사성이 두드러진 만큼 철저한 재검토가 필요하며 일본식 모델 혹은, 일본식 패러다임을 극복하기 위한 본격적인 논의가 필요하다.

근대 일본의 문화재 보호제도와 관련 법령

근대 일본의 문화재보호제도는 일본의 현대 문화재보호제도는 물론이고 한국의 근대문화재보호제도와도 밀접한 관련이 있다. ‘흑선의 충격’에서 시작된 문명개화의 시대는 貶古尙新의 사회풍조를불러왔고 神佛分離令이 공표된 이후 廢佛毁釋으로 대규모 불교문화재 파괴를 겪은 다음 1871년고기물 보존을 위한 「古器舊物保存方」이 제정되었다. 방어적인 성격의 「고기구물보존방」에비하면 1897년에 제정된 「古社寺保存法」은 문화재를 보호하기 위한 적극적인 대응의 산물이었다. 소장하고 있는 문화재를 수리, 보존하기 어려운 사찰과 신사에 보존금을 지급함으로써 문화재의해외유출을 방지하기 위해 제정된 법률로 1888년부터 이루어진 대규모 고미술조사사업이 그토대가 되었다. 고사사보존회의 자문을 얻어 ‘역사의 증징’과 ‘미술의 모범’이 될 만한 문화재를‘국보’와 ‘특별보호건조물’로 지정할 수 있도록 규정하였으며, 「고사사보존법시행세칙」을 통해 핵심적보호대상인 ‘국보’를 세 종류로 구분하고 ‘제작의 우수’, ‘유서의 특
