이 논문은 민사법리와 지적재산법리의 접점에서 발생하는 논점 중의 하나인 일반불법행위법리에 의한 지적재산법의 보완 문제를 다룬다. 최근 개개의 지적재산법으로 보호되지 않는 타인의 지적 성과물 등의 무단이용행위가 민법상 불법행위에 해당하는지 여부를 둘러싼 논의가 활발히 전개되고 있다. 현행 지적재산법의 입법적 흠결로 인해 법적 보호가 미흡한 정보들에 대해 불법행위법리에 의한 보호가 도모됨으로써 불법행위법은 지적재산법을 보완하는 역할을 수행하고 있다. 최근 우리나라의 대법원 결정과 몇몇 하급심 판결을 통해서 지적재산법의 침해가 부정되었지만 민법상 불법행위책임이 긍정된 사례들을 확인할 수 있다. 무엇보다 하급심 판결들은 저작권에 의한 보호를 부정하면서도 “부정하게 스스로의 이익을 꾀할 목적으로 이를 이용하거나 또는 원고에게 손해를 줄 목적에 따라 이용하는 등의 특별한 사정이 있는 경우”에는 불법행위책임을 인정할 수 있다고 판시하였다. 또한 대법원 결정은 불법행위책임으로서 손해배상 외에 일정

엔터테인먼트산업에서 가장 대중의 각광을 받는 사람은 연예인이라 지칭되는 저작권법상의 實演者이다. 일반적으로 실연자는 예명을 사용하여 연예활동을 하므로 실연자의 예명에 대한 법적 보호 문제가 대두된다. 이에 관하여 이 논문은 다음과 같은 구성으로 고찰하였다. 첫째, 실연자의 예명은 인격권의 보호대상인가에 관하여 검토하였다. 실연자의 예명도 일반적 인격권 내지 개별적 인격권으로서의 성명권 또는 성명표시권의 보호대상이 될 것인가 하는 점이다. 이와 관련하여 성명권 일반을 개관하고 그 보호대상인 예명에 대하여 살펴본 다음 개별적 인격권에 해당하는 성명표시권과 그 보호대상인 예명 및 성명권과 성명표시권의 관계에 대해서 고찰하였다. 즉, 실연자의 널리 알려진 예명은 성명권의 보호대상이 되므로 이러한 예명은 일반적 인격권에 의하여 보호된다는 것과, 성명권과는 별개의 권리인 실연자의 성명표시권은 저작권법에 명문의 규정이 있으므로 개별적 인격권으로 보호되는데, 이때의 성명에도 예명이 포함된다는 점을

Endovascular coil surgery for patients with unruptured intracranial aneurysms is characterized by low procedural mortality and morbidity and has advantages in patients with poor general health, cerebral infarction, posterior circulation aneurysms, aneurysms of the proximal internal cerebral artery, and unruptured aneurysms associated with ruptured aneurysm.
