본고에서는 국내 제약 시장에서 가격, 품질, 판매 촉진 활동에서의 경쟁이 어떤 방식으로 이루어지고 있는지 그리고 그에 대해 공정거래위원회, 법원, 보건복지부가 어떤 태도를 취하고 있는지 고찰하였다. 그 결과 국내 제약 시장에서는 가격과 품질에 의한 경쟁이 제대로 이루어지고 있지 않고 리베이트 중심의 잘못된 경쟁이 일어나고 있음을 확인하였다. 그래서 경쟁을 통해서 소비자(환자)의 후생이 증진되고 제품 경쟁력을 갖춘 기업이 성장하는 것이 아니라 처방권자의 후생이 증진되고 (제품 경쟁력은 없이) 리베이트 ‘경쟁력’을 갖춘 영세한 기업들로 시장이 분할되게 되었다고 결론을 내리게 되었다. 이를 해결하기 위해서는 시장에 맡길 때 더욱 효율적인 것은 시장에 맡겨야 하고 정부가 개입할 때 더욱 효율적인 것은 정부가 나서서 해결해야 한다. 그런 관점에서 리베이트 근절, 동일 성분 제품에 대한 자세한 품질 정보 공개, 가격의 상한 설정은 정부의 규제가 필요한 영역이다. 리베이트는 주인-대리인 문제(P

현행 특허법, 약사법 그리고 국민건강보험법 하에서, 신약 제약회사는 특허도전에성공한 후발의약품 진입으로 인한 신약 보험약가 인하에 관하여 (추후 그 특허가 무효가 아니라는 판단이 확정되더라도) 후발의약품 제약회사나 국가 등으로부터 손실을 보전받기 어렵고, 신약 특허권자 등의 판매금지 신청에 따라 후발의약품이 판매금지를 당하였을 때 사후적으로 그 판매금지가 잘못된 것임이 확인되어도, 국민건강보험공단이 신약 제약회사에게서 손실을 회복할 수 없다는 결론에 도달하였다. 하지만해석론적으로 본고와 다른 해석이 불가능하지 않아서 법적 안정성과 예측가능성이저해되는 상황이다. 이는 특허권의 유동적 권리성이라는 현실적인 한계 때문에 혁신에 대한 보상과 의약품 접근성 제고의 요구를 조화시키려는 특허법, 약사법, 국민건강보험법이 의도한배분적 정의가 왜곡된 것이다. 그러므로 후발의약품의 조기 진입 이후의 부당한 신약보험약가 인하에 대하여는 국민건강보험공단이 신약 제약회사에게 손실보상을 하고후발의약품 진입

Twenty-nine dogs with chronic keratoconjunctivitis sicca (KCS) were treated by topical administration of a petrolatum based 2% cyclosporine ointment twice daily. Causes and durations of KCS varied. Tear production increased in 25 of 32 eyes and clinical improvement in corneal health was noticed in 35 of 47 eyes. No serious adverse reactions were observed and only mild irritation was noticed by the owners immediately after the application of the ointment in some cases.

미국 메이저리그 야구 경기는 야구공을 추적하는 3대의 고속 카메라를 통해 모든 투구에 대한 궤적 데이터 PITCHf/x를 수집하고 공개한다. 선행 연구에서는 PITCHf/x 데이터를 통해 각 투구의 기대 피루타수를 계산하고 이를 토대로 투구의 질을 평가했다. 다만 기대 피루타수는 경기 득점으로 매번 이어지지 않기 때문에 각 투구가 승리에 기여하는 영향을 직접적으로 평가하지 못한다. 이 논문에서는 득점 기댓값과 득점 가치의 개념을 조합해 투구에 대한 기대 득점 가치를 계산하고 이를 통해 투구의 질을 랜덤 포레스트 모형으로 평가한 뒤, 기대 피루타수를 이용한 투구의 질 평가와 비교 분석한다.

Algorithm journalism refers to the practices of automated news generation using algorithms that generate human sounding narratives. Algorithm journalism is known to have strengths in automating repetitive tasks through rapid and accurate analysis of data, and has been actively used in news domains such as sports and finance. In this paper, we propose an interactive card news system that generates personalized local election articles in 2018. The system consists of modules that collects and analy
