본 연구는 역사 제도주의적 관점에서 1965년 한일어업협정, 1974년 한일대륙붕공동개발협정, 1998년 신한일어업협정을 중심으로 한일 해양질서가 최종적 경계획정으로 수렴하지 못하고 불안정한 구조로 남게 된 원인을 경로의존성 개념을 통해 분석한다. 특히 각 협정에서 Pierson의 경로의존성의 대표적 특징인 다중균형, 우연성, 시점과 순서의 중요성, 관성이라는 네 가지 관점에서 살펴본다. 한국과 일본 양국은 해양경계를 명확히 그리는 대신, 어업과 자원개발 같은 당장의 현안을 관리할 수 있는 잠정적 공동관리 방식(공동규제수역, 공동개발구역, 중간수역 등)을 선택해 왔으며, 1965년 한일어업협정에서 형성된 선택이 이후 협상의 틀을 반복적으로 제약하는 경로의존적 구조를 규명한다. 나아가 2028년을 기점으로 한일대륙붕공동개발협정이 재조정될 경우 동북아 해양경계 문제 전반의 불확실성이 커질 가능성을 전망한다.
