국내 체류 중인 외국인은 급속히 증가하고 있으나, 우리의 외국인 포용에 대한 사회적 인식과 정책적 배려는 현실을 따라가지 못하는 것 같다. 우리 헌법 제6조 제2항에는 외국인의 인권도 보장해야 할 것을 규정하고 있다. 그리고 우리는 다양한 인권장전 조약을 비준함으로서 인간에 대한 보편적 인권을 보장하겠다고 국제사회에 표명을 하였다. 특히, 우리는 아동권리협약을 비준하여, 동 협약 상의 아동권리가 우리나라에 체류하는 미등록 이주아동 포함한 모든 아동에게 보장되어야만 한다. 그럼에도 불구하고 현재 국내에 체류하고 있는 수많은 미등록 이주아동이 생존과 밀접한 관련이 있는 최소한의 의료서비스 조차도 받기 어려운 실정에 놓여있다. 미등록 이주아동에게 의료접근 권리를 보장한다는 것은 우리 사회에서 가장 차별받는 약자에 대한 인도주의적인 배려라는 점과 비준된 아동권리협약 상의 국가책무라는 점에서 접근되어야 한다. 그리고 미등록 이주아동의 의료접근 권리를 보장하는 문제는 임신한 미등록 이주민에 대

본 논문에서는 영리법인 의료기관의 허용과 관련된 배경적ㆍ제도적 논의를행하였다. 이를 위하여 헌법재판소의 최근 결정의 다수 및 소수 의견을 분석하여 논의 전제로서의 쟁점을 도출하였다. 헌법재판소의 논의에 따르면, 영리의료법인 허용의 궁극적인 쟁점은 법인 의료기관 개설 및 운영과 의료인의 의료행위가 영리성이라는 측면에서 논리필연적으로 상호 관련성을 가지는 것인가에있다. 다수의견의 경우 이러한 논리필연적인 관계를 인정하고, 따라서 보건의료의 질적 향상과 공공성을 보장하기 위해서는 영리법인 의료기관을 허용할 필요성이 없다는 입장을 견지한다. 그러나 의료기관의 개설 및 운영의 문제는 의료인의 의료행위와 필수적으로 결부된 사항은 아니라고 할 수 있으며, 더욱이 이러한 사실은 현재 절반을 넘는 의료기관 및 병상이 영리 목적으로 운영되는 개인병원에 의해 유지되고 있다는 점에서 확인할 수 있다. 이러한 분석을 전제로, 본 논문은 보건의료의 공공성 확보를 위한 대안을 법인 의료기관의 개설 및 운영이라
