MPTB patients undergoing surgery with or without adjuvant RT had a favorable outcome. Although there was no local recurrence in patients treated with adjuvant RT, the effect of adjuvant RT failed to reach a statistical significance. 대상판결은 의사결정능력이 있는 미성년자인 환자에 대한 의사의 설명의무를 처음으로 다룬 대법원 판결일 뿐만 아니라 어떠한 경우에 의사가 의사결정능력이 있는 미성년자 환자에게 ‘직접’ 설명할 의무를 부담하는지에 대한 판단 기준을 제시하였다는 점에서 중요한 의미가 있다. 대상판결은 우선, 의사는 의사결정능력이 있는 미성년자인 환자에 대해서 의료행위에 관하여 설명할 의무를 부담한다고 선언하였다. 다만, 이때 설명의무는 원칙적으로 ‘간접적’ 설명, 즉 친권자 또는 법정대리인에게 설명하여 그 설명이 미성년자에게 전달되도록 하는 방식으로 이행할 수 있고, 예외적으로 미성년자인 환자에게 직접 의료행위에 관하여 설명하고 승낙을 받을 필요가 있는 ‘특별한 사정’이 있으면 미성년자인 환자에게 ‘직접’ 설명하는 방식으로 이행하여야 한다고 한다. 결국, (1) 미성년자가 의사결정능력이 있고, (2) 직접 설명하여야 하는 특별한 사정이 인정되는 두 단계의 요건이 충족되는 경우에만 의사가 미성년자 환자에게 ‘
