Professor Haksoo Ko's research lab specializes in the intersection of law, technology, and data science, with a strong focus on data privacy, artificial intelligence governance, and regulatory frameworks in digital economies. The lab investigates the legal and ethical implications of machine learning and big data, particularly in Asian contexts, including South Korea’s evolving data protection regime and the impact of algorithmic decision-making on discrimination. It also conducts empirical studies on data collection practices in digital platforms, including cookies and mobile app data harvesting, to inform policy and legal reform.

이 논문은 국내의 주요 인터넷 웹사이트와 애플리케이션 프로그램(앱)을 통해 수집되는 개인정보의 현황에 관해 파악하고 분석하는 논문이다. 조사결과 쿠키를 통한 정보의 수집은 주요 웹사이트에서 상당히 광범위하게 이루어지고 있는 것으로 파악되었다. 주요 웹사이트에 발견된 평균 당사자 쿠키는 12.48개이고 평균 제3자 쿠키는 8.44개이다. 이는 미국에서 2009년에 조사된 현황과 비교하면 매우 높은 수치인 한편, 미국에서 2011년에 조사된 현황과 비교하면 상대적으로 낮은 수치이다. 미국의 2011년 자료와 비교하면, 국내 웹사이트 현황의 가장 큰 특징은 당사자 쿠키의 개수는 그리 큰 차이가 없는 반면에 제3자 쿠키는 미국에 비해 20%에도 못 미치는 수준으로 훨씬 적게 발견된다는 것이다. 다른 한편, 쿠키 파일의 활용현황은 PC 환경과 모바일 환경에서 상당히 다른 양상을 보인다. 가장 큰 차이는, PC 환경에 비해 모바일 환경에서는 쿠키의 활용도가 현저히 낮다는 것이다. 이와 같은 쿠

이 글은 행동법경제학의 시각에서 우리나라 증권법, 소송법, 회사법 영역에서의 몇 가지 현안에 대해 분석한 내용을 소개하는 글이다. 첫째로 2009년 이후 대규모 소송이 진행되면서 많은 사람들이 관심을 가지게 된 키코(KIKO) 계약에 대한 행동법경제학적 분석을 소개한다. 행동법경제학의 관점에서 애초에 어떻게 해서 이와 같은 독특한 구조를 가진 계약이 유행처럼 체결되었는지에 관해 생각해 보고 정책적인 면에서 어떤 점을 고려할 필요가 있을지에 관해 생각해 본다. 둘째로 조정(mediation)제도에 관한 행동법경제학적 분석을 소개한다. 조정절차를 진행함에 있어서 발생할 수 있는 당사자들의 편향(bias)으로 인한 문제 및 그러한 문제의 해결을 위한 조정자의 역할에 대해 생각해 본다. 세 번째로는 기업의 의사결정 과정에서 발생할 수 있는 편향 및 합리적이지 못한 판단의 가능성에 관한 행동법경제학 시각에서의 문제의식을 살펴본다.
