The use of standard dose and maintenance BCG instillation may be effective to reduce recurrence rate after TURBT for NMIBC. Further large scale, well-designed, and prospective studies, with stratification of the patients into risk group at randomization, will be required to determine the optimal guideline of BCG use to improve clinical outcomes in NMIBC.

본고는 민사적 환경책임의 내용을 개관하고, 그것을 정책적으로 평가하는 것을 목적으로 한다. 우리 학설과 판례에 의해 인정되고 있는 환경침해를 이유로 하는 손해배상 법제의 내용을 정리하고, 그것을 비판적으로 평가하고자 하는 것이다. 동시에우리 법제에 대한 시각을 확보하기 위하여 독일의 환경책임법리를 개략적으로 살펴보고, 그것이 우리나라의 입법에 시사하는 바를 탐색해 보고자 한다. 본고는 크게두 부분으로 나뉜다. 전반부에서는 환경침해를 이유로 하는 손해배상 책임에 대한현행 법제를 살펴본다. 이는 일반 불법행위법에 의한 손해배상과 특별법에 의한 손해배상으로 구별되는데, 전자와 관련해서는 민법 제750조의 요건과 관련되는 내용,특히 위법성 판단과 인과관계 입증의 문제를 살펴보고, 후자와 관련해서는 환경정책기본법의 위험책임적 성격을 검토한다. 후반부에서는 독일의 환경책임법제를 개관하고, 특히 무과실의 위험책임을 규정한 환경책임법의 내용을 상세히 검토한다. 결론에서는 본문의 서술을 기초로 우리

독립적 은행보증 즉 요구불 조항과 결합한 손해담보계약은 현재 국제거래에서 빈번하게 사용되는 인적 담보 수단이다. 본고에서는 이러한 요구불 손해담보계약의 특징인 비부종성을 민법상의 보증계약과 관련하여 살펴 본다. 특히 두 인적 담보제도가 구조적으로 어느 정도의 공통점과 차이점을 가지고 있는지를 살피고 그에 따라 어떠한 경우에 상이한 법적 취급이 요구되며 또 어떠한 경우에 동등한 취급이 필요한지를 검토하기로 한다.

Hinsichtlich des § 389 des koreanischen Bürgerlichen Gesetzbuchs geht die jetzt herrschende Lehre davon aus, daß die ersten drei Absätze verfahrensrechtlicher Natur sind.
