오늘날 비교적 동질적인 문화를 가졌던 전통적인 국민국가들은 자본과 노동의 세계화에 따른 이주노동자와 낯선 문화, 그리고 새로운 종교의 유입과 함께 다문화사회의 도전에 직면하고 있다. 단일민족과 단일문화를 강조하던 우리나라 역시 점점 다양하게 분화되는 인종과 문화, 지역과 종교 등의 도전으로부터 자유롭지 못하다. 이와 같은 상황에서 시민으로서 권리와 의무는 무엇이어야 하고, 시민으로서 공동의 정체성은 어떻게 확보될 수 있을까? 나아가서 한 사람의 시민이 탄생하는데 국가의 역할은 어떻게 정의 되어야 할까? 이 논문에서는 다문화 시대에 적합한 시민의 개념을 모색하기 위해 자유주의와 자유방임주의, 그리고 공화주의 전통에서 주장하는 시민의 모습에 대해 검토하고, 이 세가지 이념형을 기준으로 최근 우리나라에서 이루어지고 있는 바람직한 사회구성의 원칙과 시민의 역할을 둘러싼 논의를 검토하고 있다. 오늘날 우리 사회에는 의외로 공화주의적 입장의 강화 필요성을 강조하는 목소리들이 많다. 그러나, 어

인종과 종교, 그리고 문화적 소수 집단이 주장하는 사회적 인정과 문화적 생존의 요구는 어떤 이론적 근거에 의해 정당화될 수 있을까? 이 논문에서는 대표적인 다문화주의 이론가들인 홀과 파레크의 논의를 통해 소수의 문화적 권리를 옹호하는 논리적 근거를 살펴보고,이에 대한 비판을 베리, 케이텝, 거트만의 논의를 통해,그리고 지지의 입장을 테일러, 라즈, 킴리카의 논의를 통해 검토한다. 필자는 두 입장의 차이를 좁힐 수 있는 문화의 도구적 역할에 주목하여, 대표의 위기와 연대의 위기를 가져오는 문화의 도구적 역할때문에 소수집단이 주장하는 문화적 생존의 요구에 어떤 식으로든지 대답해야 한다는 점을 설명한다. 단, 문화의 중요성과 문화집단의 인정여부, 그리고 문화적 권리에 대해 긍정적인 답을 얻기 위해서는 상호존중과 합리적 대화, 그리고 정치적 권리라는 세가지 규범조건들로 이루어진 심의 다문화주의의 틀이 전제되어야 한다고 주장한다.

이 글은 덴마크 만평 사건과 샤를리 엡도 사건을 통해 다문화 사회로의 이행에서 대표적인 도전 가운데 하나인 표현의 자유와 혐오표현의 관계, 그리고 종교의 자유와 혐오표현의 관계를 정치이론 차원에서 추론하고, 표현의 자유와 종교의 자유가 혐오표현의 범주를 피해서 양립할 수 있는 가능 성을 심의다문화주의 모델을 통해 살펴보고자 한다. 두 사건에서 나타난 표현의 자유와 혐오표현의 규제 여부를 둘러싼 논쟁은 표현의 자유가 혐오표현의 규제에 의해 제약될 수 있으며 그 기준은 자 신이 선택할 수 없었던 주어진 정체성에 근거한 혐오표현이 우선 해당되고 종교 역시 선택 가능한 후천적 정체성 요소에 해당되어 표현의 자유가 보장하는 비판의 대상에 포함된다는 점을 보여준다. 그러나 이 경우에도 종교자체에 대한 비판과 그 종교를 따르는 개인 및 집단에 대한 혐오표현은 구 분되어야 한다. 전자는 표현의 자유의 권리가 보장되지만 후자는 혐오표현으로 규제의 대상이 된 다. 그렇지만 법적 규제는 그 상징성에 의
