Professor Yoon Jin Shin's research lab focuses on transnational constitutionalism, human rights adjudication, and the dynamic interaction between domestic constitutional courts and international human rights law. The lab explores how constitutional courts—particularly the South Korean Constitutional Court—engage with global legal standards, especially in cases involving civil and political rights, socioeconomic rights, and transnational human rights challenges such as human trafficking. It also examines the evolving interpretation of state responsibility beyond territorial boundaries, including the jurisdictional reach of human rights obligations in an era of global mobility and interdependence.

유럽인권재판소는 당사국의 유럽인권협약 위반 여부를 심사함에 있 어 ‘판단의 여지’(Margin of Appreciation) 독트린을 통해 당사국 정부 가 협약의 해석과 적용에 대하여 넓은 판단여지를 가진다는 이유로 문제된 차별행위나 권리제한조치가 정당하다고 보는 판결을 다수의 사안에서 내려오고 있다. 유럽인권재판소는 사생활의 자유, 사상・양 심・종교의 자유, 표현의 자유, 집회・결사의 자유 등 국제적으로 그 제 한에 대하여 엄격한 심사기준이 확립된 영역에 해당 독트린을 적용하 고있다. 재판소는문제된사안이해당사회의도덕, 종교, 문화와밀 접하게 연관되어 있거나 사안의 쟁점에 대하여 협약 당사국들 사이에 통일된 입장이 없다고 판단되는 경우 개별 국가에 대하여 광범위한 판단의 여지를 인정하는 경향을 보인다. 재판소는 이와 같은 해석태 도의 일반적 근거로서 보충성의 원칙, 국내 기관이 인권해석에 있어 국제 재판소보다 원칙적으로 우월하다는 전제, 당사국의 주권과 민주 주의에대한존중등을제시하고

초국경적 이동성과 지구적 상호의존성이 증대하고 인권침해와 인권위기의 양상이 다변화, 초국경화되고 있는 현실에서 국제인권조약 당사국의 인권의무 범위에 대한 영토중심적 접근은 한계를 가질 수밖에 없다. 주권국가 간의 법적 권한 경계로서의 국제공법상 전통적 ‘관할권’ 개념과 국가와 인권주체 개인 간의 관계에 초점을 두고 국가가 가지는 인권의무의 상대방 범위를 정하는 국제인권조약상 ‘관할’(jurisdiction) 개념은 규범적으로 중요한 차이가 있다. 그러나 최근까지 유럽인권재판소는 유럽인권협약 당사국이 부담하는 인권의무 상대방 범위로서의 ‘관할’의 의미가 원칙적으로 일반 국제공법상 해당 국가의 영토적 관할권과 일치한다고 보면서, 개별 사안에서 ‘실효적 지배’라는 개념을 통해 예외적으로 당사국의 역외 인권의무가 인정될 수 있는지를 판단하는 방식을 취하고 있다. 자유권규약위원회와 미주인권재판소의 경우 초국경적 인권사안에 보다 적극적으로 대응하기 위한 새로운 해석적 접근을 제시하고 있으나,

국제인권법상 인권침해 피해를 입은 사람은 효과적인 구제를 받을 권리를 가지며, 국가는 피해자가 국내법절차를 통하여 그러한 구제조치를 제공받을 수 있도록 보장할 의무를 지닌다. 인권침해가 사인에 의하여 행해진 경우 이는 국내법절차 내에서 주로 민사상 불법행위 사건으로 다루어지게 될 것이므로, 민법은 국제인권법상의 국가의무가 국내법체계를 통하여 실현되는 중요한 장이기도 하다. 그러나 현재 국내법상 인권침해에 대한 구제조치 제도와 실무는 국제인권규범상 피해자의 권리를 효과적으로 보장하고 있다고 보기에 부족한 점들이 있다. 물권과 지식재산권 등의 권리침해에 대한 구제조치는 민법과 특별법을 통하여 상대적으로 두텁고 다각적으로 보장되어 있는 반면, 인권침해에 대한 민법상 구제수단은 원칙적으로 사후적 금전배상으로 한정되어 있으며, 명예훼손 사안을 제외하고는 원상회복조치가 허용되지 않고, 법원의 해석에 의하여 인격권 침해에 대한 금지청구권이 일부 인정되고 있는 상황이다. 국제인권규범이 요청하는 신
