본 논문의 목적은 (가)최근 20-30년 간 서구학계, 특히 영·미 학계에서의 페미니즘 이론의 일련의 흐름을 파악, 분석하고 (나)서구 페미니즘 이론이 한국학계에서 지니는 의미를 살펴봄으로써, 이를 바탕으로 앞으로 한국 페미니즘 이론이 나아가야 할 방향을 제시하는데 있다. 먼저 서구 페미니즘 이론이 1980년대를 기점으로 이전과 비교하여 어떠한 변화를 보이고 있는지 분석한다. 특히 이론의 변화 흐름을 방법론, 내용면, 분석대상의 세 가지 측면으로 나누어 살펴본다. 구체적으로 방법론의 측면에서는 비판(critique)에서 건설(construction)로, 내용면에서는 평등(equality)에서 자유(liberty)로, 그리고 분석대상의 측면에서는 성(gender)에서 사회정의(social justice)로 동향을 나누고, 각각의 동향에서 보여지는 주요 쟁점과 의의를 살펴본다. 마지막으로 이러한 서구 페미니즘 이론의 변화와 쟁점이 한국학계에 어떠한 의미를 갖는지 알아보고, 한국적 맥락에

베커는 영국의 절대왕정에 대항하고 개인의 자연권을 보호하는 것을 강조하는 로크의 정치이론을, 윌스는 사회의 공공선을 위해 역할을 하는 개인의 자선을 강조하는 허치슨의 윤리이론을 독립선언문의 사상적 출처라고 간주한다. 제퍼슨의 독립선언문의 사상적 기원이 로크냐 혹은 허치슨이냐에 관한 베커와 윌스 간의 논쟁을 해결하기 위해서는 우선 먼저 베커와 윌스가 로크와 허치슨을 바르게 이해했는지에 대해 살펴볼 필요가 있다. 이를 위해서 다음 절에서는 로크와 허치슨의 저서를 중심으로 로크와 허치슨의 재산권과 행복의 개념을 분석해 보고자 한다. 그리고 이러한 분석을 토대로 IV절에서는 베커와 윌스의 주장의 정당성을20) Wills, op. cit., p.231.21) Ibid., pp.227-39.22) Wills, op. cit., p.250.평가하고, 생명권, 자유권, 행복추구권을 독립선언문에 적은 제퍼슨의 실제 의도를 파악해 보고자 한다.

본 논문의 목적은 국제규범으로서 당연시 여겨지는 난민보호의 규범성에 대해재성찰을 시도하는 것이다. 난민은 보호받아야 하는가? 어떤 근거로 개별 국가를포함한 국제사회는 난민보호의 책임이 있는가? 본 논문은 난민협약과 난민의정서에 반영된 규범적 원칙과 논리를 모두 포괄하지 못하겠지만, 비록 시론적인 수준에서 나마 어떤 규범적인 근거와 이유로 난민을 보호해야 하며 지원해야 하는지에대한 근본적인 논의를 풀어보기로 한다. 이러한 목적으로 논문은 인권, 박해, 비자발적 이주에 근거한 난민보호의 규범성 논리와 더불어, 이러한 논리가 국가주권, 문화권리, 자발적 이주의 논리와 서로 갈등하고 있음을 살펴본다. 본 논문의 의도는 난민법의 제정과 시행에 관한 문제제기도 아니며 국제규범으로서의 난민보호에대한 회의를 지적함도 아니다. 오히려 난민보호의 국제규범을 따르고 이를 국내법으로 보다 잘 수용하기 위해서, 난민보호의 규범성에 대한 기초를 견고히 다질 필요가 있음을 강조한다. 또한 당연히 받아들이고 있

본 연구의 목적은 한국 영주권제도 개선 방안의 규범과 실제에 대해서 살펴보는 것이다. 단순히 서구 영주권제도의 모방 및 답습을 넘어서는 논의를 위해서, 우선 규범적인 측면에서 영주권제도를 분석함으로써 영주권제도의 정책지향을 분명히 하고자 하였다. 특히 Habermas의 논의를 바탕으로 영주권제도의 존재 이유 및 필요성을 고찰하였다. Habermas의 논의를 통해 국가의 구성원으로서 살아가기 위한 일정한 조건을 갖춘 사람이라면 새롭게 시민으로 구성될 수 있는 가능성을 확인하였고, 그러한 가능성을 영주권제도를 통해 실현시킬 수 있다고 주장하였다. 실제적인 측면에서는 Habermas의 논의에서 얻은 규범적 정책방향을 기초로 영주권제도의 개선 방안을 구체적으로 제안하고자 하였다. 「국적법」과 「출입국관리법」을 평가하여 특정 외국인들에게 영주권 취득을 위한 기회를 평등하게 제공하지 못한다는 한계를 확인하였다. 아울러 그들에게 필요한 권리가 무엇인지에 대한 고민을 바탕으로 제도적 기반이 이루어
