본 연구는 전장유전체 분석(Whole Genome Sequencing, WGS)에서 이차적으로 발견된 의미있는 유전자 결과를 환자에게 고지하는 임상 제도의 도입과 관련된 법적·윤리적 쟁점을 고찰하고, 임상 단계별 권고사항을 도출하는 것을 목적으로 한다. 이차발견은 의료적 유용성을 제공함과 동시에 환자의 심리적 부담, 가족 고지, 개인정보 보호, 취약집단 동의 등 복합적 쟁점을 수반한다. 또한 이차발견 결과 반환 관련 제도화를 위한 법제의 적용가능성을 분석할 필요가 있다. 이를 위하여, 본 연구는 문헌 분석을 통해 이차발견의 개념과 유형을 체계화하고, 비교법적 연구방법을 통해 미국, 유럽 학회 및 영국 보건기관의 권고사항을 중심으로 환자의 자기결정권, 알 권리와 모를 권리의 균형, 미성년자 보호와 관련된 윤리적 쟁점을 검토한다. 또한, 주요 쟁점 별 국내 법령을 비판적으로 분석하여 해결방안을 모색한다. 본 연구는 임상에서 이차발견 유전자 검사 결과를 환자에게 반환하는 절차를 세 단계로
