장성현 교수의 연구실은 디지털 기술과 문학, 예술, 사회적 가치가 만나는 지점에서 연구를 전개합니다. 기술 수용 이론과 개인정보 보호 법리 분석을 통해 현대 사회의 기술적·정서적 영향을 분석하고, 동시에 영국 로맨티시즘과 프리러너널리즘 문학을 중심으로 언어, 예술, 사랑의 철학적 기능을 탐구합니다. 특히 기술의 인간적 영향과 예술이 지닌 사회비판적 기능을 연결하여, 보다 인간다운 사회를 위한 이론적 틀을 모색하고 있습니다.

본 논문은 최근 빈번히 발생하고 있는 개인정보 유출 사건에 대한 법적 판단 틀과 관련 판례를 분석하여 정신적 손해의 인정 기준을 고찰한다. 개인정보의 유출은 피해자에게 심리적 고통을 초래할 뿐만 아니라, 그로 인해 발생하는 불안감과 사회적 신뢰의 상실은 매우 심각한 문제로 대두되고 있다. 연구는 대법원 판례를 중심으로, 유출되는 정보의 종류, 제3자의 열람가능성, 그리고 정보 유출이 야기하는 추가적 법익침해 가능성 등을 중심으로 하여 정신적 손해의발생 여부를 판단하는 방법을 제시한다. 특히, 주민등록번호와 같은 민감한 정보가 유출되었을 때 발생하는 손해배상책임에 대한 법원의 접근방식을 분석하고, 일본의 유사사례를 살펴봄으로써 국내외 판례 간의 차이를 조명한다. 정신적 손해는 명백한 심리적 불편이나 불안감뿐만 아니라, 계속해서 발생할 수 있는 추가 피해에 대한 두려움으로 인해 더욱 심각한 고통을 수반한다. 결론적으로, 개인정보 유출로 인한 피해자의 정신적 고통을 인정하는 것은 법적 안
