이 연구는 소비자 후기의 명예훼손 성립에 관한 합리적 기준을 제시한 2012년 ‘산후조리원 판결’ 이후 선고된 관련 형사판결 63건을 분석하여 소송 현황, ‘산후조리원 판결’ 인용 경향, 정보통신망법상 명예훼손죄의 구성요건인 ‘비방의 목적’에 대한 판단을 살펴보았다. 분석 결과, 상소율은 47.4%(1심 61.1%, 2심 23.8%)로 나타났고, 판결의 약 60%가 항소심 이상에서 확정되었다. 무죄율은 45.9%였고, 사실적시 명예훼손 사건은 무죄율이 65.4%에 이른 반면, 허위사실적시 명예훼손 사건에서는 모두 유죄가 선고되었다. 상소심의 원심유지 비율은 90.5%로 나타났다. 명예훼손 단일 혐의 사건에는 모두 벌금형이 선고되었고, 그 액수는 평균 108만 원이었다. ‘산후조리원 판결’ 인용률은 41.7%였고, 사실적시 명예훼손 사건에서의 인용률(53.8%)이 허위사실적시 명예훼손 사건(10.0%)보다 높게 나타났다. ‘산후조리원 판결’을 인용한 경우의 무죄율(86.7%)은 그렇지

<언론중재법> 제17조는 범죄혐의가 있거나 형사상 조치를 받았다고 보도된 자의 형사절차가 무죄판결 등의 형태로 종결되었을 때 이를 보도하여 줄 것을 언론에 요구할 수 있는 추후보도청구권을 규정하고 있다. 그러나 추후보도청구권은 형사절차 개시라는 엄격한 요건으로 인해 당사자가 형사절차의 대상이 된 적이 없다면 행사가 불가능한 문제가 있다. 이로 인해 경미한 혐의가 보도된 자의 인격권은 면밀히 보호하면서도 중대한 혐의에 관한 행정처분 사실이 보도되었지만 형사상 조치는 받지 않은 자의 구제는 원천적으로 차단하는 부정의를 초래할 위험이 있다. 이 연구는 전술한 문제의 해결 방안으로 추후보도청구 요건 완화를 제시한다. 즉 범죄보도 당사자가 혐의에 관한 행정처분이 무효확인･취소판결 등 형태로 종결된 경우에도 추후보도를 청구할 수 있도록 하는 것이다. 위와 같이 개선된다면 추후보도청구권이 범죄보도로 인한 인격권 피해를 구제하는 역할을 더욱 충실히 할 수 있을 것으로 예상된다.

이 연구는 MBC의 일명 ‘바이든ᐨ날리면’ 보도에 대하여 외교부가 제기한 정정보도청구 소송에서 원고의 개별적 연관성을 인정한 제1심판결을 법리적으로 검토하는 것을 목적으로 한다. 기존 판례분석 결과 법원은 보도에 원고의 사회적 평가 내지 신뢰를 저하하는 사실적 주장이 적시되었는지 여부를 기준으로 개별적 연관성을 판단하는 태도를 보였다. 그런데 ‘바이든ᐨ날리면’ 사건 담당재판부는 ① MBC가 외교부가 대통령의 외교활동을 제대로 보좌하지 못하여 대통령의 발언 논란을 야기하였다는 취지로 보도하였고, ② 국회에서 가결된 외교부장관 해임건의안의 제안이유 중 하나로 대통령 발언 관련 책임을 들고 있다는 등의 사정을 제시하며, 비록 외교부가 보도에서 직접적으로 지명되지 않았더라도 보도 내용과 개별적 연관성이 있다고 보았다. 이러한 판단은 일반 시청자가 뉴스를 보는 관점을 제대로 반영하지 못한 것으로 보인다. 또한 보도에서 ‘외교 안보라인’으로 언급되었을 뿐인 외교부장관을 두고 외교부의 개별적 연
